Terms and Conditions

For the purposes of interpretation and application of these General Terms and Conditions of Service (hereinafter "Terms"), the following terms shall have the meanings attributed herein, whether used in the singular or plural, capitalised or not, unless the context requires otherwise.

These Terms apply to all relationships between the Operator and the User in connection with the Service, including pre-contractual relationships. These Terms prevail over any conditions proposed by the User, unless otherwise agreed in writing by the Operator.

The Service consists exclusively of the temporary provision of a physical space within the Area for vehicle parking. The contract between the Operator and the User is to be qualified as a temporary use concession, NOT as a deposit, custody, vehicle rental or any contract involving obligations of surveillance, conservation or protection of the Vehicle or the User's belongings.

The Operator does NOT assume custody of the Vehicle under any legal provision whatsoever, and bears absolutely no responsibility for the surveillance, integrity, conservation or safety of the Vehicle or any object therein.

Any presence of staff in the Area has exclusively organisational purposes and does not constitute assumption of custody, surveillance or guarding obligations.

The User expressly acknowledges that the commercial name "Parcheggio Custodito Maia" has descriptive value only and does not imply any legal custody obligations.

Access to the Area is permitted exclusively during opening hours established by the Operator in connection with Events, indicatively 8:00 to 20:00. The Operator reserves the right to modify access hours at any time.

Access is conditional upon: (i) presentation of the Booking Confirmation received via WhatsApp or, without a formal booking, verification of available spaces by staff; (ii) full payment of the agreed amount; (iii) compliance with staff instructions.

The Operator reserves the unconditional right to deny access to any User at any time for any reason, without any obligation to compensate.

Booking is made via the online form and WhatsApp message. Booking requests do not give rise to any right to obtain the Service.

A Booking becomes binding exclusively upon explicit written Confirmation from the Operator. Without such Confirmation, the User has no right of access.

The Operator reserves the absolute right to refuse any booking request, to not respond to requests (silence constituting refusal after 24 hours), to revoke an already issued Confirmation, or to make Confirmation subject to specific conditions.

Confirmation does not grant rights to a specific space within the Area. The Operator assigns spaces with full discretion.

Prices are determined and communicated individually by the Operator via WhatsApp at Confirmation. Prices may vary based on vehicle type, number of days, event, remaining availability and any other factors at the Operator's discretion.

Payment is exclusively in cash at the Area entrance upon arrival. No advance payment, deposit or pre-authorisation is required or accepted. The Operator does not issue fiscal receipts or invoices unless expressly requested before access.

The User expressly, fully and irrevocably acknowledges that the Operator — including its members, directors, employees, collaborators and agents — declines all liability, contractual and tortious, for:

Use of the Area occurs under the full, exclusive and irrevocable responsibility of the User. The Operator offers no guarantee regarding the safety of the Area or its suitability for vehicles of any type or value.

Users parking high-value vehicles (including classic, sports, super or hypercars, competition motorcycles, modified vehicles) expressly acknowledge that the Operator cannot offer custody, surveillance or protection commensurate with the vehicle's value. The risk is entirely and irrevocably borne by the User. Users must verify their insurance covers risks associated with parking in private, unguarded areas.

The User is required to:

The User is personally and fully liable for any damage caused to third parties, other vehicles, Area structures or Operator staff.

The User irrevocably undertakes to indemnify, hold harmless and defend the Operator and all associated parties from any claim, action, liability, loss, damage, cost or expense (including legal fees) brought by third parties arising from: (a) use of the Service; (b) breach of these Terms; (c) damage caused by the User, their Vehicle or persons they introduced into the Area; (d) any false representation made to the Operator.

Users leaving vehicles in the Area overnight expressly acknowledge that no Operator staff are present outside opening hours, no surveillance is provided, and all risk during overnight hours is entirely and irrevocably borne by the User. Access during closed hours is not permitted.

The Operator is not required to perform its obligations when prevented by circumstances beyond its reasonable control, including extreme weather, natural disasters, fires, terrorism, pandemics, government orders, strikes, power outages or event cancellation. In such cases no refund, indemnity or compensation of any kind is owed.

Within the Area, the following are expressly and absolutely prohibited:

Violations authorise the Operator to demand immediate vehicle removal, deny future access and pursue legal remedies.

The Area is not equipped with EV charging infrastructure. No electrical connection for charging is permitted without explicit written authorisation. The Operator bears no responsibility for battery depletion during the stay or related consequences.

In case of breach of these Terms, the Operator may, at its sole discretion and without prior notice: demand immediate vehicle removal; permanently or temporarily ban the User from the Area; charge the full cost of any damage caused; report the behaviour to competent authorities; initiate legal proceedings.

The Area is private property. Users must respect all structures, furnishings, vegetation and elements of the complex. Any damage will be charged in full to the User.

The Operator reserves the right to photograph and film the Area, including parked vehicles, for promotional, documentary or security purposes. Use of the Service implies implicit consent to such activity.

The User may cancel or modify a Booking at any time via WhatsApp without penalty (no advance payment having been made). Modifications are subject to availability and require new Confirmation.

To the maximum extent permitted by law, even if the Operator were found liable, its total liability shall not exceed the lesser of: (a) the amount actually paid for the Service on the relevant day; or (b) fifty euros (€50.00). The Operator bears no liability for indirect, consequential, punitive or special damages.

Processing of Users' personal data is governed by the Privacy Policy on the website, in compliance with EU Regulation 2016/679 (GDPR).

The Operator may modify these Terms at any time without notice. The version applicable to each visit is that in force at the time of access. Users are advised to periodically review the latest version.

If any provision is found invalid or unenforceable, such invalidity shall not affect remaining provisions, which remain fully valid and effective.

Failure to exercise any right does not constitute waiver thereof. No waiver is effective unless made in writing by an authorised representative of the Operator.

These Terms, together with the Privacy Policy, constitute the entire agreement between the parties and supersede all prior agreements, representations and communications.

All communications regarding the Service occur via WhatsApp. Messages are deemed received when delivered according to the application's indicators.

These Terms are governed exclusively by Italian law. The Court of Rimini (Italy) has exclusive jurisdiction over any dispute. The parties expressly waive any other forum.

Physical access to the Parking Area constitutes the User's full, unconditional and irrevocable acceptance of these Terms in their entirety, including all liability limitation and exclusion clauses.
